Nepal's Community Forest User Groups

Nepal's community forest user groups give forest users a legally recognized body, conditional management and use rights, and a collective fund while the state retains land ownership and plan oversight. National and local studies associate the program with forest and poverty gains but also find caste, gender, political, labor, biodiversity, and carbon-distribution limits.

Policy experiments became user-group authority

Nepal's first substantive national community-forestry rules were the Panchayat Forest and Panchayat Protected Forest rules of 1978. Those rules placed forests under local political units but transferred little practical authority. Field experiments and documentation of existing user institutions then shifted policy toward groups defined by forest use rather than administrative boundaries. The 1989 sector plan, 1990 implementation guidelines, and 1993 Forest Act made that user-group model the basis for later expansion.1

The program is now large enough that scale claims require a date and a source. In a July 2025 joint announcement, FAO and the Federation of Community Forestry Users Nepal reported more than 23,000 community forest user groups managing about 2.4 million hectares. Those are rounded partner figures, not an audited public registry reconciled group by group.2

Users receive a corporate body, not title to the land

The current Forests Act keeps ownership of national-forest land with the Government of Nepal and defines a community forest as national forest handed to a users' group. A group applies with a work plan. Once the Division Forest Officer approves it, the group may develop, conserve, use, and manage the forest; sell and distribute products; and set prices. Registered users' groups are autonomous bodies corporate with their own funds and the capacity to hold property, sue, and be sued.3

That autonomy is conditional. A work-plan amendment requires consultation with the local government and notice to the forest office. The Division Forest Officer can stop implementation judged likely to cause significant environmental harm and can cancel registration and take the forest back for serious work-plan violations, subject to notice and appeal. CFUG authority is therefore neither ordinary private ownership nor authority exercised outside public law.4

The bargain ties restraint to products and retained revenue

The Act lets a group keep revenue from forest products, grants, fees, and fines. It also directs at least 25 percent of annual income to forest development, protection, and management; at least 25 percent of the remainder to poverty alleviation, women's empowerment, and entrepreneurship in coordination with the local government; and the balance to other user-group interests. These are legal allocations, not evidence that every CFUG complies or that each expenditure reaches its intended beneficiaries.5

A national matched observational study combined census poverty measures, high-resolution forest-cover change, and records for more than 18,000 community forests. Comparing otherwise similar subdistricts over 2000–2012, it estimated that community forest management contributed on average to lower deforestation and poverty and made joint improvement more likely. Estimated deforestation effects were weaker where baseline poverty was higher and stronger for older and larger community forests.6

That result is important but bounded. Matching cannot eliminate every unmeasured difference between treated and comparison places. The unit was a subdistrict, the period ended in 2012, forest-cover change is not forest quality or biodiversity, and average poverty does not reveal who inside a place gained.7

Average success can widen a local gap

A later national study disaggregated that average. It joined official CFUG formation dates to random samples from the 2001 and 2011 censuses, covering 522,440 rural households, and used a two-way fixed-effects design. The estimated poverty reduction was strongest for Brahmin, Chhetri, and Newar households, smaller for Janajati households, and statistically indistinguishable from zero for Dalit and other minority households. Program implementation predicted a wider within-ward poverty gap—about 0.15 standard deviations between Dalit and Brahmin, Chhetri, or Newar households.8

The authors do not find that the program increased poverty for marginalized groups; they find that its estimated gains were distributed unevenly. They also warn that the study concerns 2001–2011, treats a ward as exposed after its first CFUG, classifies households through the household head, and cannot estimate gender inequality or assume the same effects after federalization. The article was corrected in June 2026 to replace one reference and expand its explanation of how Newar households were categorized.9

Smaller studies help identify mechanisms without establishing national prevalence. A 2021 survey of 1,111 households in 45 CFUGs across three districts found few significant access differences when households were grouped by caste or wellbeing rank, but executive-committee membership and political status were associated with more lucrative timber and loan benefits. Female-headed households were negatively associated with access to every benefit studied, significantly so for some benefits.10

Recent qualitative work also separates representation from control. Interviews with 45 women, ten focus groups, and observations in Sindhupalchok and Kavrepalanchok found persistent barriers across decision-making, resources, income, leadership, and time. The researchers describe meeting schedules, technical language, informal male decision-making, and exclusion from timber and fund decisions as constraints on meaningful participation. The two-district, project-linked sample carries participants' accounts but cannot estimate how common those patterns are nationwide.11

Protection and participation are work

Meetings, monitoring, rule enforcement, and forest maintenance consume time as well as money. A study of 309 households in eight mid-hill forest user groups estimated that richer households paid more transaction costs in absolute terms, but those costs represented 26 percent of resource-appropriation costs for poor households, compared with 24 percent for middle-wealth and 14 percent for rich households. The study was conducted in two districts and published in 2006, so its percentages should not be treated as current national rates.12

The organizational question is consequently not only whether everyone may attend. It is who can give time, who performs unpaid or weakly recognized work, whose information travels into the plan, and who receives products or income in return. Those questions keep a formally collective fund from becoming evidence of equal benefit by itself.

Federation changes the scale of bargaining

FECOFUN says it was established in July 1995 to connect forest user groups and promote and protect users' rights through capacity-building, technical support, policy advocacy, and networking. Its current site describes a network spanning 23,026 CFUGs and states commitments to inclusive democracy, gender balance, and social justice.13

That is a participant-controlled account of the federation's identity and reach—not an independent audit of membership, representation, or policy effect. Federation nevertheless changes the institutional possibility: a CFUG can coordinate across localities instead of facing forest offices, markets, and national policy alone. Whether federation leaders reproduce or counter the inequalities inside member groups remains a separate empirical question.

Federalism added public partners and overlapping claims

After the 2015 Constitution, local governments became a new interface for CFUG governance. A 2022 study based on policy review, 120 stakeholder interviews, and observations in four CFUGs in Bagmati and Gandaki found collaboration around ecotourism alongside conflict over forest-office structure and taxes claimed at multiple levels. More than 80 percent of its stakeholder sample favored a larger local-government monitoring role, while most forestry officials interviewed were reluctant. Four groups in two provinces cannot stand for the country, but the study shows why “the state” is no longer a single negotiating partner.14

Carbon makes the authority boundary visible

Carbon is not treated like ordinary timber revenue. Section 44 of the Forests Act gives the Government of Nepal responsibility for arranging the management, use, and distribution of carbon-service benefits. A May 2025 government report to the UN climate regime says federal law places carbon services at the federal level and that the 2022 Forest Regulation directs 10 percent of carbon benefits to fund management, 80 percent to institutions and forest user groups involved in management, 5 percent to private forest owners, and 5 percent to forest-dependent households outside user groups.15

The same report describes 2024 free, prior, and informed consent guidance and consultations with Indigenous Peoples and local communities. It also says there was still little information on whether REDD+ programs were securing statutory rights to lands, territories, and resources. The report covers safeguard implementation during 2018–2023 and was produced by the implementing government in part to satisfy conditions for results-based payments; it is not an independent evaluation of consent, grievance resolution, or who ultimately received money.16

That source expected Nepal's first payment under one emissions-reduction program in the second half of 2025. The report does not establish whether it was paid, how much reached particular CFUGs or nonmember customary users, or how recipients distributed it. Those are research needs, not blanks to fill with the statutory formula.17

Forest cover is not biodiversity

The national forest-cover study supports a qualified claim about reduced deforestation, not a general claim that CFUG management protects every species. Research in the 22 community forests of Jalthal in southeastern Nepal surveyed several taxonomic groups, reviewed all 22 operational plans, and worked with local forest leaders. It documented a species-rich forest and important local uses, while finding that operational plans recorded only a narrow share of its trees, management emphasized timber, invasive plants threatened the forest, and current practices were insufficient for specific biodiversity needs.18

Jalthal is one remnant lowland forest, not a representative national sample. Its lesson is narrower and more useful: a canopy can persist while inventories, species composition, habitat structure, and invasive pressure remain poorly governed. Nonhuman life does not receive representation merely because a CFUG has protected an area from clearing.

Read this case beside Japan's iriai forest commons to compare how membership, boundaries, monitoring, and public law are organized. In Nepal, the cited record shows a statutory corporate body and national federation alongside state land title and important oversight, including carbon authority. The pairing proposes a comparison; it does not claim historical influence, identical membership, or interchangeable public law, and the reviewed sources establish none.19

The institution now faces a different countryside

A 2026 historical reassessment argues that outmigration, remittances, urbanization, agricultural-land abandonment, a more feminized rural workforce, and reduced subsistence dependence in many—but not all—rural communities have weakened the assumptions under which CFUGs were designed. It is a scholarly synthesis by a long-term participant in Nepal's community-forestry history, not a new national household survey, and it explicitly calls for the model to be reconsidered rather than declaring it obsolete.20

The central achievement therefore remains conditional. Forest users acquired a durable public body, management rights, a fund, and a federation. The open test is whether those institutions can adapt without converting aggregate forest recovery, statutory inclusion, or carbon eligibility into proof of equal voice, equal benefit, or ecological sufficiency.

Concept fingerprint: a commons gained legal form without becoming equal

Purpose, mission, and institutional legitimacy has supporting weight. CFUGs join forest conservation, household use, livelihood, poverty, and collective development in one local body. Their legitimacy depends not only on statutory recognition or canopy retention but on whether customary users, poorer households, women, caste and ethnic groups, and future users can shape those purposes.358

Authority, legitimacy, and acceptance is defining. The state owns the land, a registered group holds conditional management and use rights, the forest office approves and can suspend a plan, and local government enters amendment and spending processes. Formal membership creates authority without proving that every user accepts boundaries, rules, or representation.3416

Delegation, decentralization, and responsibility is defining. Nepal delegated substantial forest work and product decisions to user groups while retaining land title, environmental oversight, appeal, and carbon authority. Federalism added provincial and local interfaces, so decentralization is a negotiated allocation of responsibility rather than a complete transfer away from the state.41415

Coordination, communication, and common understanding has supporting weight. Constitutions, operational plans, assemblies, committees, forest offices, local governments, FECOFUN, and carbon safeguards connect local practice to national policy. Technical language, informal male decisions, and overlapping tax claims show where a formal meeting or plan does not create a shared operating picture.111314

Structure, hierarchy, and scale has supporting weight. More than 23,000 reported groups make a modular national system, while FECOFUN supplies federation and public bodies retain hierarchical oversight. Rounded partner and federation counts show scale but are not a reconciled registry or proof that every module has equivalent capacity.213

Decision making, judgment, and bounded rationality has supporting weight. Groups judge harvest, protection, prices, access, spending, labor, conservation, and enterprise under changing migration, markets, ecology, and public rules. National averages, local access studies, and qualitative participation records answer different questions and cannot substitute for the judgment required in one forest.61020

Measurement, accounting, and control has limited weight. Operational plans, income shares, forest-cover change, poverty indices, benefit categories, transaction costs, carbon allocations, and biodiversity inventories each make part of performance visible. Canopy is not biodiversity, statutory allocation is not expenditure compliance, and average poverty is not equal distribution.57818

Cooperation, incentives, and organizational equilibrium is defining. Conditional rights, retained product revenue, a collective fund, social spending, local monitoring, forest benefits, and federation give users reasons and capacity to cooperate. Unequal access, time costs, political status, and carbon centralization can also move the equilibrium away from poorer or less powerful users.5101215

Work design, productivity, and automation has supporting weight, correcting the imported zero. Meetings, patrol, monitoring, silviculture, administration, harvesting, and enterprise work consume time, and the cited studies directly document disproportionate costs and gendered participation. Current national task, pay, time-use, and automation evidence remains missing.121119

Knowledge, expertise, and professional autonomy has supporting weight. Users bring embedded ecological and livelihood knowledge; foresters and public offices shape plans; researchers measure poverty, cover, and species; federation and carbon programs add legal and policy expertise. Technical language can also exclude members, while a timber-centered inventory can omit the species users are meant to steward.1118

Learning, quality, and reliability has supporting weight. The policy evolved from weak local-political delegation to user-defined groups, then expanded through iterative plans, federation, and federal and carbon rules. Longitudinal average gains support learning at scale, but distributional and biodiversity evidence shows that forest-cover success is not a complete quality signal.16818

Strategy, competition, and adaptation has limited weight. CFUGs can adapt harvest, enterprises, tourism, and collective spending, while federation changes their bargaining position with the state and markets. Migration, remittances, reduced subsistence use, federalism, and carbon finance now alter the environment, but the reviewed evidence does not establish one national competitive strategy.131420

Innovation, entrepreneurship, and renewal remains at score zero as an independent lens. The user-group legal form and collective fund are institutional innovations, and the Act reserves money for entrepreneurship. The cited studies do not independently measure enterprise survival, new product creation, or whether carbon programs renew local authority rather than recentralize it.51619

Governance, stewardship, and accountability is defining across land title, group constitutions, operational plans, spending, appeal, local-government coordination, federation, carbon benefits, and ecological obligations. Accountability requires both public checks and member power; neither state approval nor a collective label establishes equal internal control.34514

Culture, informal organization, trust, and voice is defining. Committee membership, political status, meeting time, technical language, informal male decisions, caste and gender, and federation all affect who speaks and whose knowledge becomes a rule. Bounded local studies illuminate mechanisms but do not establish one culture across Nepal's CFUGs.101113

The zero score for executive attention, information, and organizational sensing is retained because the system is primarily local and federated and the cited record does not reconstruct a distinct executive-attention mechanism. Committee, forest-office, FECOFUN, and ministry attention appears elsewhere under authority and coordination; treating it as one central sensing system would overstate the evidence.141519

Organizational ignorance has supporting weight rather than the imported zero because aggregate forest and poverty success can hide distributional inequality, formal representation can hide informal exclusion, and canopy can hide biodiversity decline. This is an editorial classification of measurement and voice gaps, not a claim that every committee or official knows or ignores the same facts.78111819

The declared links to authority, delegation, cooperation, governance, and culture are conceptual lenses grounded in those mechanisms. The benefit-for-all-life link is an ethical audit of how member, community, work, forest, species, carbon, and future effects are counted. The links do not assert direct influence or terminology adopted by the cited institutions.19

Evidence still needed

  • A current, reconciled public registry of CFUGs, forests, households, and operational-plan status.
  • Nationwide compliance evidence for the income allocations in Section 22, disaggregated by caste, ethnicity, gender, wealth, location, and tenure.
  • Member and nonmember testimony on customary and Indigenous rights, seasonal access, boundary disputes, grievance outcomes, and exclusion.
  • Current time-use, paid-work, and unpaid-labor evidence for meetings, patrol, silviculture, administration, and forest enterprises.
  • Landscape-representative measures of biodiversity, water, fire, invasive species, wildlife conflict, and forest quality beyond canopy cover.
  • Verified carbon-payment flows from the federal fund to CFUGs, customary users, other forest-dependent households, and final household or collective uses.

Paths into deeper study

  • Follow one operational plan from user mapping through approval, harvest, revenue distribution, revision, and an access dispute.
  • Compare how women, Dalit members, Indigenous users, poorer households, migrants, and seasonal users experience the same forest rule.
  • Trace one timber, carbon, or conservation payment from measurement and contract through the group fund to its final beneficiary.
